BURR TRAVEL/MELISSA IN PARADISE Terms and Conditions
Booking through Burr Travel creates a contract between Burr Travel and any travelers, customers, and/or purchasers (“Customer”) which is subject to the following terms and conditions:
CANCELLATION: Bookings are often non-refundable and cancellations often subject to charges pursuant to the terms and conditions of Suppliers. Customer is solely responsible for the cost of such charges and agrees to indemnify Burr Travel in the event that Burr Travel incurs any liability for any such cancellation fee or charge, including fess or charges related to credit card transactions.
Burr Travel charges a Cancellation Fee of $100 per traveler 18 years and older once Customer places a deposit on a booking. If you have any questions, or any penalties are unclear, please contact your Burr Travel Agent. All cancellation fees will be charged to the credit card you authorized to pay for travel services or deducted from Supplier’s refund, if applicable. This Burr Travel charge may be in addition to other Supplier cancellation fees. These fees may be able to be claimed on Travel Insurance if Customer purchased such a policy.
CHANGES: Burr Travel charges a Change Fee of $50 per traveler 18 years and older once Customer places a deposit on a booking and voluntarily requests changes to this booking.
FEES: All Service Fees, including Changes Fees, Air Service Fees & Planning Service Fees, are non-refundable.
Special Notice: Criminal Offenses (Felony, DUI or DWI)
Each foreign country holds different views of past criminal offenses, therefore if Customer has a current or past offense, it is the Customer’s responsibility to determine the specific entry and exit requirements of each country they are traveling to as some may exclude admission. As an example, Canada often denies entry to travelers with a DUI conviction.
LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE: Burr Travel acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“Supplier(s)”) and is NOT the source or provider of the travel services. Each of these Supplier companies is an independent entity with its own management and is not subject to the control of Burr Travel. Customer is advised that the Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, consents to the use of those Suppliers, and understands that each Supplier’s services are subject to their own terms and conditions governing the transaction. Supplier Terms and Conditions include, but are not limited to, their payment schedules, cancellation schedules, and pricing validity. All bookings are accepted by Burr Travel as an agent for the Suppliers on your itinerary. The transportation, accommodations and other services provided by the identified sea, ground, and air operator Suppliers offered are subject to the terms and conditions contained in the tickets, invoices, exchange orders or vouchers issued by them and/or their suppliers, including Terms and Conditions on their respective Web sites.
BECAUSE BURR TRAVEL ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE BURR TRAVEL IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. BURR TRAVEL HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH BURR TRAVEL’S OFFICE OR THROUGH THIS WEB SITE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS OUTSIDE OF BURR TRAVEL’S CONTROL, AND YOU HEREBY EXONERATE BURR TRAVEL FROM ANY LIABILITY WITH RESPECT TO THE SAME.
Weather conditions, including but not limited to the presence or absence of snow, sunshine, rainfall, or seaweed are not guaranteed to occur or not occur, and are clearly outside of Burr Travel’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by Suppliers and your travel insurance company, which is beyond the control of Burr Travel. Burr Travel reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time. Burr Travel shall not assume any responsibility for any air and/or ground schedule changes.
Burr Travel has solely received commission and fees for travel transactions and Customer agrees and understands that any recovery from Burr Travel resulting from any acts, errors, or omissions of Burr Travel will be limited to the commission and fees paid by Customer actually received by Burr Travel except where such liquidating of damages is against law or public policy.
Passport validity, immunizations, VISA requirements, REAL ID compliance, and other entry requirements are the sole responsibility of the Customer.
GOVERNING LAW AND JURISDICTION: In the event that Customer breaches all or any portions of the Terms and Conditions, Customer shall be liable for all of Burr Travel’s costs and expenses (including, without limitation, attorney’s fees, court costs, process server fees, and all related disbursements) incurred by Burr Travel to enforce Burr Trave’s rights. Any action arising out of a breach of the Terms and Conditions shall be brought exclusively in the Supreme Court of the State of New York, County of Suffolk, and the Parties hereby consent to the jurisdiction of such Court for that purpose, agree that it is a convenient forum, and unconditionally waive all rights to make any argument to the Court based on the doctrine of forum non conveniens, removal, or any similar doctrine. The Terms and Conditions shall be governed by and construed in accordance with the law of the State of New York, without giving effect to any choice principles.
CLAIMS DEADLINE: Customer agrees to present any claims against Burr Travel within 30 days after date of return of trip and to file a suit within one year of the incident, and to acknowledge that this expressly limits the applicable statute of limitations to one year.
TRAVEL INSURANCE: For the protection of the Customer, Burr Travel strongly recommends the purchase of trip cancellation and travel accident insurance. However, no representative or description of the insurance made by Burr Travel to Customer constitutes a binding assurance or promise about the insurance. Burr Travel is not an insurance company and has no responsibility for the submission, payment, or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy. NOTE: unless a Cancel-for-Any-Reason policy is purchased, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place.
FINANCIAL CONDITION OF TRAVEL SUPPLIERS: Burr Travel is not responsible for the acts or omissions of any Supplier or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. Burr Travel has no special knowledge regarding the financial condition of Suppliers, therefore has no liability for recommending a trip credit in lieu of a refund.
HEALTH AND OTHER HAZARDS: You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. Burr Travel assumes no responsibility for and shall not be liable for unsafe conditions or health hazards including pandemics or other illnesses. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "International travel” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers
for Disease Control website at w ww.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country.
RULES OF TRAVEL SUPPLIERS AND GOVERNMENTS: Burr Travel has no responsibility for COVID-19-related requirements, or any other requirement, that travel Suppliers and governments may impose from time to time, such as health affidavit forms, health screenings prior to departure or upon arrival, face coverings, or quarantines. RELEASE: YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS COVERED ABOVE, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD BURR TRAVEL, AND ITS AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.
